Right to list agreement company MV Realty is being attacked again by the Ohio Attorney General. The lawsuit was filed by the Ohio Attorney General Dave Yost last Monday at the Franklin County Common Pleas Court. Yost claims that MV Realty’s contracts are in violation of Ohio state law and that the company does not have proper real-estate licensing.
Yost is now seeking a preliminary injunction against MV Realty Ohio and its founder, Amanda Zachman, as well as the principal broker, Diana Remar to stop them from negotiating real-estate contracts.
MV Realty is currently facing this fourth lawsuit from state attorneys general. The firm was sued by attorneys general from Florida, Massachusetts, and Pennsylvania at the end of 2022.
The lawsuit in Ohio alleges that MV Realty founder Amanda Zachman, and broker Diana Remar misled homeowners with company contracts. These contracts omit critical information required by state law.
“The Homeowner Benefit Programme and Homeowner Benefit Agreement are misleading. They confuse homeowners.” Yost wrote that the HBA agreement mirrors an agency agreement and an exclusive right-to-list agreement.
According to the suit, HBP contracts do not include information and language required by Ohio state law. This includes the name of the agent, the required fair housing language and the required anti-blockbusting terminology, as well as the statement that the agreement will expire and the statement of representation.
The lawsuit also claims that Zachman, who lives near Delray Beach in Fla., isn’t licensed in Ohio to be a real estate broker, but is acting illegally as one through MV Realty and Remar. At the time of publication, MV Realty did not respond to a request for comment.
